 The use and possession of cannabis is illegal under federal law for any purpose in the US.                                State laws on medical and recreational use varies by state.

The Legalities

CBD / THC Laws Across America

 In the United States, the use and possession of cannabis is illegal under federal law for any purpose, by way of the Controlled Substances Act of 1970. Under the CSA, cannabis is classified as a Schedule I substance, determined to have a high potential for abuse and no accepted medical use – thereby prohibiting even medical use of the drug 


 

The 2018 Farm Bill made it legal to grow hemp, or cannabis containing less than 0.3 percent THC, throughout the United States. It also made hemp-derived CBD products federally legal.

Marijuana, or cannabis containing more than 0.3 percent THC, isn’t federally legal.

State laws vary. In some states, it’s allowed to be used medically and recreationally. In other states, it may only be used medically. And in some states, it’s still completely illegal.

Legalities by State

Alabama

Cannabis is illegal for recreational use in Alabama. However, a bill to legalize it for medicinal use passed in 2021. 

Alaska

In Alaska, weed has been legalized for both medicinal and recreational use. The age limit is 21 years. Adults can possess up to an ounce of marijuana and grow up to six plants per residence. 

Arizona

Weed has been legalized for medicinal use but not for recreational use. Surprisingly, licensed medicinal cannabis patients can grow their weed at home with a maximum limit of twelve plants. 

Arkansas

Medicinal cannabis has been legalized in Arkansas, but with very strict regulations. Recreational weed is yet to be legalized. 

California

California is a pot paradise, having been the first state to legalize medicinal cannabis in 1996. Two decades later (2018), recreational weed was legalized. Adults can carry up to 1 ounce of weed and grow up to 6 plants for personal use. 

Colorado

Following closely after California is Colorado which was the first state to legalize recreational weed. This state has a very vibrant cannabis community. Adults can carry up to 1 ounce of weed and grow up to six plants at home. 

Connecticut

Legal for medicinal & recreational use up to an amount of six plants with only three at a time being mature.

Delaware

Delaware has allowed medicinal cannabis for several conditions. However, the bill for recreational weed use passed in April of 2023 without the governor's signature. 

Florida

Florida has legalized medicinal marijuana. But when it comes to recreational weed, the laws are still stringent. 

Georgia

Georgia has stringent cannabis laws, even though it has allowed medicinal cannabis. CBD oil with less than 5% THC is the only form of cannabis that has been accepted for medical use. 

Hawaii

Medicinal cannabis has been allowed in Hawaii. Marijuana as a whole has been decriminalized 

Idaho

Idaho will not touch weed, not even with a ten-foot pole. Both medicinal and recreational weed is illegal. 

Illinois

Illinois is a cannabis progressive state. In Jan this year, they became the 11th state to legalize recreational weed. Adults 21 and older can possess up to 30 grams of weed. 

Indiana

In Indiana, you will not expect to find any medicinal marijuana dispensaries. However, CBD with less than 0.3% THC is allowed. 

Iowa

Both medicinal and recreational weed is illegal in Iowa state 

Kansas

Medicinal cannabis has not yet been legalized in this state. However, there is a law that allows CBD if it contains a zero amount of THC. 

Kentucky

Cannabis, in whichever form, is illegal in Kentucky.  

Louisiana

Medicinal cannabis has been legalized in this state for the treatment of several conditions. 

Maine

In Maine, adult-use cannabis has been legalized. Adults can carry 2.5 ounces of weed and grow up to six plants in private residences. 

Maryland

Marijuana has been legalized for both medical and recreational uses in July of 2023!

Massachusetts

This is another pot paradise as rec weed has been legalized. Adults can carry one ounce and grow up to six plants at home. 

Michigan

Recreational weed was legalized at the beginning of 2018. Adults can carry 2.5 ounces and grow 12 plants per household. 

Minnesota

Medicinal and recreational use of cannabis has been legalized. 

Mississippi

Cannabis has been decriminalized but in 2022, the medicinal use had been made legal again. This was after the Supreme Court overturned this bill back in 2020.

Missouri

In 2022, Missouri voters approved the Marijuana Legalization Initiative , legalizing recreational use for adults 21 and older.

Montana

Montana has legalized medicinal cannabis and has a good number of cannabis dispensaries. 

Nebraska

Cannabis is illegal for both medicinal and recreational use. However, CBD Oil (containing up to 0.3% THC) is legal for any use.

Nevada

Weed is legal for recreational and medicinal use. Adults may grow six plants per household and possess one ounce of weed. 

New Hampshire

Medicinal marijuana has been legalized and patients can even grow some at home. 

New Jersey

Medicinal and recreational use of cannabis has been legalized. 

New Mexico

Medicinal and recreational use of cannabis has been legalized. 

New York

Full legalization has taken place in New York!

North Carolina

As much as medicinal cannabis has not been legalized, patients with severe epilepsy can access CBD treatment. 

North Dakota

North Dakota allows marijuana for medicinal reasons. 

Ohio

Ohio has legalized medicinal and recreational use for cannabis. 

Oklahoma

Oklahoma has one of the most vibrant medicinal cannabis programs. Adult-use weed is illegal though. 

Oregon

Marijuana is fully legal in Oregon. Adults may grow a maximum of four plants at home. 

Pennsylvania

Medicinal marijuana has been legalized. 

Rhode Island

Medicinal cannabis is allowed for the treatment of several conditions. They've also legalized cannabis use for recreational purposes. 

South Carolina

CBD oil has only been legalized for the treatment of severe childhood seizures. CBD oil has to contain less than 0.9% THC. 

South Dakota

Medicinal marijuana has been legalized in South Dakota. 

Tennessee

There are no cannabis dispensaries in this state, even though patients with epilepsy are allowed to use CBD with less than 0.9% THC.  

Texas

Medicinal cannabis is legal, though it only covers a few severe conditions. 

Utah

Utah has a restrictive medicinal cannabis program which covers a few specific conditions. 

Vermont

Marijuana is legal for adults over 21 years. However, adults have to grow their pot at home; a maximum of six plants per household. 

Virginia

Weed for medicinal and recreational use is legal in VA. 

Washington

Weed has been legalized both for medicinal and recreational use. 

West Virginia

Medicinal cannabis is legal though it cannot be used in the flower/ plant form. 

Wisconsin

Both medicinal and recreational weed is illegal in Wisconsin. However, patients may access CBD oil for treating seizures. In 2020, recreational use was legalized in Madison, the state capital.

Wyoming

Wyoming has not legalized cannabis for medicinal or recreational use.
